The Linguistic Constraints of Legal Drafting
Abstract
The legal drafting of the administrative regulations, charters, decisions, and rules has become very crucial for its great impact on the regulations of states' and their bodies.
One of the most important components of the legal drafting is the language structure; therefore, I have studied it from all its perspectives, and have come up with specific controls.
I have attempted to proceed with this study by conducting a linguistic investigation of the following:
- The Basic Law of Governance, issued in 1412AH.
- The Traffic Law, issued in 1428AH, and its executive regulation, issued in 1429AH.
- Banking Control Law, issued in 1386AH.
I have concluded that there are several constraints which can be classified into four categories: moral constraints, verbal constraints, structural-stylistic constraints, and spelling and punctuation constraints. These constraints are different in terms of their importance and the number of mistakes made in their category.
