Abstract

The research aims to answer two questions:

First, Is the science of Fiqh's origins derived from the science of speech?

Second, Does the dispute in the derivation of jurisprudence from the science of speech have an impact?

The research was conducted on the method of induction and analysis, and the research was introduced by showing the truth of speech science.

The research then addressed the answer to the first question by stating the origin of the dispute in the issue and stated that the fundamentalists see the derivation of Fiqh origins from the science of speech with indicating pieces of evidence and discussions. Then the research considered the detail more likely, which is to deny the extension, which means to consider the rule and prove the state of being competent which means extrapolation from the branch. Then the research addressed the answer to the second question and stated that some fundamentalists made the dispute conventional and then suggested that the dispute has an effect and shows its effect from three aspects, which are importance and revenue and branching.
