Comparison between the Fundamental Jurisprudential and Linguistic Considerations in the Nominal Analogy

Abstract

Research correlation between between fields that are interdisciplinary with a link of issues in knowledge and its methodologies is among the phenomenon of authorship in the sources of knowledge, and it is an issue that needs to be tracked and monitored, and by noting the observations that would give inklings on the points of agreement and the points of disagreement, and underscoring the points of distinction between these various schools and sciences, and deducing the area of correction that could be observed on the originating and application process.

In contribution to this kind of researches that deals with the study of methodologies of various sciences, and comparison between them, and concluding with a critical and evaluation perspective, the researcher aims at applying this kind of studies and researches on the research correlation  and an interdisciplinary methodology that has gained popularity, which is the relationships and points of correlation, on the details of knowledge and its general methodologies: between both sciences of fundamentals of jurisprudence and the science of Arabic language.

As a case study, the researcher has chosen to compare between both sciences using the issue of (establishing language through analogy “qiyas”), navigating the account of the classical literature of both fundamentals of jurisprudence and language regarding the permissibility of formulation and establishment of the basis of names and words for the end of incidents and materials, and doing so through the justifiable analogy, premised on appropriate attributes in both sides of existence and non-existence.

In order to reach a methodological study of this interdisciplinary issue: the researcher highlighted four topics; a topic on originating the fundamental of jurisprudence perspective on this issue, then another separate topic on originating the linguistic perspective, then a last topic on comparison between these two schools on this research correlative.

Among the methodologies applied in studying the issues of this research and in deducing its findings include: the objective study methodology, upon which the majority of the issues of the first and the second topics were premised, then the critical analytical study methodology upon which the majority of the sub-topics of the last topic were premised.

Almighty Allaah has made this research possible, and it concluded on certain findings that are expected to be enriched at the level of interdisciplinary studies between various sciences, most especially both sciences of fundamentals of jurisprudence and language. The most significant findings of the research include: That the linguistic classical literature were mute about most of the sub-topics of this correlation issue, and they did not discuss them except for a very few statement and analysis, and that those issues that they were mute about were mentioned in the literature of fundamentals of jurisprudence, which tapped from the scholars and arbiters of language in a way that made it correlate with the linguistic perspective on this issue, although in the hand of the scribe of fundamentals of jurisprudence.
