Abstract

Abstract:

This research aims to articulate a legal ruling on issue the creation of a machine that replaces a natural womb/uterus, so that the fertilized egg is placed in it from the moment of external artificial insemination until the hour of completion of fetal development and birth.

The research followed the descriptive and analytical approach by describing the process as expected, then it applied the jurisprudential study of the subject in light of opinions therein. The research concluded by dividing the ruling into two forms:

The first, using an artificial uterus as a substitute for purposes other than a medical need or necessity, such as maintaining the beauty of the body and avoiding sagging. The researcher has concluded that this form is not permissible.

The second, using an artificial uterus as a substitute for a natural one due to a medical necessity. The researcher has concluded that it is permissible. This approach is permissible within a number of controls.
