The Religious Regulations of the Electronic Medical Consultation

Abstract

 

The electronic health has got up in our time, and its importance has increased due to the breadth of electronic dealings' fields and progress which the world has experienced in all fields of life, and i have dealt with in my research: (Jurisprudence provisions related to electronic medical consultation),with many issues related to the provisions of this consultation and its images, the ethics of this profession and obligations of the medical consult and consulting and its effects.

By looking at reality of images of electronic medical consult, we find that a number of these consultation can be externalized to lease contract (al-Ijarah) for the great similarity between them, while there are other types of medical consultation can be externalized to payment wages (al-Juaala) due to the similarity between them.

It is right to execute the electronic medical consultation contract form via verbal and written means of communication, and it is also allowed for the infidel to offer medical consultation if his opinion's fidelity is guaranteed. It is not required in the medical consult to be a male, because women have a position in Islam. Her consult is a legitimate approach in the limits of her competence and capabilities.
