Abstract

This study aims to demonstrate the concept of the consensus of the people of Al-Madinah; as well as elucidate the relationship between this concept and the Islamic fundamentalism consensus. Furthermore, it attempts to examine Al-Imam Malik's views on the consensus of the people of Al-Madinah as well as the terminologies he developed for this matter. Moreover, it determines the extent to which Al-Imam Malik and his companions and followers apply this principle in their inference, deduction and jurisprudential sub-divisions. Also, it discusses the categories of the consensus and the work of the people of Al-Madinah. In addition, it resolves the issue of debate between the Islamic fundamentalists, regarding the argument of this principle. The researcher attempts to add to what our early scholars and our Islamic fundamentalists have established with regard to the concepts, expressions, divisions, inferences, and sub-divisions.
