Abstract

Shari'a sanctions were legislated as a mercy from God (Allah) over his servants; it was issued by the mercy of God and the will of the charity to them, including: Capital punishment, which, although appears as a cruel punishment, but its truth is mercy to the criminal and the society, deterring the non-perpetrator, establishing justice among people, satisfying the guardians of the victim, and purifying the criminal from guilt. It is God's mercy to his servants that he ordered the capital punishment to be carried out in the most accessible way, which was explicitly expressed by the Messenger of Allah (peace and blessings of Allah be upon him) when he said: "Verily Allah has prescribed ihsan (proficiency, perfection) in all things. So if you kill then kill well; and if you slaughter, then slaughter wellﭗ" [Muslim 1955]

 

This research aims to address the capital punishment execution tool, and is it necessary to be done in all cases by the sword - retribution, stipulation, or rebuke -or is it justifiable to be replaced with what was found in people's lives today with the gallows.
