Abstract

The Abstract

Praise be to Allah, and peace and blessing upon Prophet Muhammad and his relatives and companions.

From the favours of Allaah is making us Muslims, and making the religion complete and suitable for all periods and places, and from the completeness of the religion is the injunctions of the Law-giver not limited to the apparent connotation of the text only, rather it extends to the interpretation which can be used to explain the intent  and the objective of the Law-giver. Based on this, the researcher chose to prepare this research titled: “Objection to the Proof Through Argumentative Interpretation”.

The nature of the research necessitated its division into: Introduction –including: the importance of the research, its problem, its objective, the literature review, the research plan, its methodology-, and the preface, three topics, the conclusion, the bibliography, and list of topics.

Regarding the methodology followed in this research, it could be summarized as the known and extant approaches that are followed in academic researches. 

The most significant findings of the research include: That “al-I’tirād” (objection) means: countering the opponent in his statement with a counter-argument that would prevent his intent from being achieved. Also, that the meaning of “al-Tahwīl” (argumentative interpretation) according to the scholars of the Fundamentals of Jurisprudence (al-Usūl) is: diverting a word from the apparent connotation to a less-preponderant connotation, due to the latter being buttressed with a prevailing proof that makes it more preponderant than the meaning of the apparent connotation, while its meaning according to the scholars of Polemics is: An explanation of the fusion of probability into a word, buttressed by another proof from the text or analogy, such that the probability –due to being buttressed with proof- becomes a counter to the apparent or even takes precedence over it. And that among the most popular ways from the question of argumentative interpretation arise according to the scholars of the Fundamentals of Jurisprudence generally and the scholars of Polemics especially, include: the argumentative interpretation of the apparent, and the specification of the general, and interpreting the absolute with the restricted, and the researcher has discussed each of these ways comprehensively.

In the conclusion of the research, the researcher recommends giving attention to the matter of objections, like objection to a proof with the claim of it being a shared authority, or objection to a proof by agreeing to its premises but arguing its consequence, and so on. This kind of studies are worth being researched and deserve attention and study.
